Terms of service

1. Who provides the service

The service is provided by Jonathan França de Souza, NIF 316017540, address Rua Capitão José Pacheco, 6, 2910-573 Setúbal, Portugal, hereinafter the operator. You can reach us at support@memotakes.com.

2. Acceptance

Using the site and buying credits means accepting these terms in the version published at the time of purchase. If you disagree with any clause, do not use the service.

3. What the service is

An AI restoration service for old photographs. You upload a photo, choose what you want done to it (repair the damage, add colour, or enlarge it for print) and the system returns that same photo treated. The service is delivered entirely online, with no physical shipment.

4. Minimum age

You must be at least 18 years old to use the service and to make a purchase. The service is not aimed at minors and uploading images of minors is not allowed under any circumstances.

5. What you are buying

You buy a one time credit pack. One credit unlocks one of the generated images, which becomes available sharp, in high resolution and downloadable. Credits do not expire.

• This is not a subscription: there is no auto renewal and no recurring charge.
• Credits are personal, non transferable and cannot be exchanged for cash.
• One restoration delivers a watermarked preview and consumes no credits.
• Restoring is free: you only pay if the result convinces you. One credit unlocks that photograph in high resolution, watermark free.

6. Prices, taxes and payment

Prices are shown in euros for Spain and Portugal and in United States dollars elsewhere, always as a final amount: that is what is charged, with any applicable taxes already included and no extra fees at the next step. Payment is processed by Stripe Payments Europe. The operator does not store and has no access to full card details. Stripe emails the receipt; if you need an invoice with your tax details, write to support@memotakes.com.

7. Delivery

Delivery is immediate and digital. The specific conditions are in the delivery policy, which forms part of these terms.

8. Permitted use

You may only upload photos of yourself, or of adults who have expressly and verifiably authorised you to use their image for this purpose.

9. Prohibited uses

The following is expressly prohibited and leads to account closure with no refund of consumed credits:

• Uploading images of minors.
• Uploading images of third parties without their express consent.
• Impersonating another person or creating material that misleads about who appears in the image.
• Generating sexual, violent, defamatory, discriminatory or otherwise unlawful content.
• Using the results for fraud, extortion, harassment or to bypass identity verification systems.
• Attempting to extract, replicate or reverse engineer the models or the system.
• Automating use of the service or circumventing credit limits.

10. Ownership of the results

The generated images are yours. You may use them for personal and commercial purposes, including advertising. The operator reserves the right to show examples generated by the operator for promotional purposes, never customer images without prior written permission.

11. Nature of the output

The service uses generative technology. Results are variable by nature and there is no guarantee that a specific image will meet a specific expectation. That is why each generation delivers several variations and why the commercial guarantee in the refund policy exists.

12. Availability

The operator aims to keep the service continuously available but does not guarantee uninterrupted operation. It may be suspended temporarily for maintenance or for reasons outside the operator control.

13. Account suspension

The operator may suspend or close access for a user who breaches these terms, with immediate effect and without prejudice to any legal action.

14. Right of withdrawal and digital content

By unlocking an image you expressly request immediate performance of that part of the service and acknowledge that, once performed, you lose the statutory right of withdrawal over that consumed credit, under European distance contract rules. Generating is free and consumes no credits, so unconsumed credits keep the right of withdrawal in full.

15. Commercial guarantee

Regardless of the above, the operator offers a voluntary 14 day commercial guarantee described in the refund policy. This guarantee is additional and does not replace your statutory consumer rights.

16. Liability

To the extent permitted by law, the operator liability is limited to the amount actually paid by the user in the twelve months before the event giving rise to it. There is no liability for indirect damages, data loss or loss of profit. Nothing in these terms excludes liability for wilful misconduct or for personal injury.

17. Force majeure

The operator is not liable for failures caused by events beyond its reasonable control, including outages at hosting, payment or AI model providers.

18. Changes

These terms may be updated. The version applicable to each purchase is the one published at the moment it is made. Substantial changes are announced on this page with an updated revision date.

19. Governing law and dispute resolution

Portuguese law applies, without prejudice to the mandatory consumer rules of the country where the user habitually resides. Before going to a third party, write to support@memotakes.com: almost everything is settled there, at no cost. Failing agreement, the consumer may refer the dispute to an alternative consumer dispute resolution body. The body with residual jurisdiction for the operator is CNIACC · Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, at www.cniacc.pt; the full list of registered bodies is at www.consumidor.gov.pt. Under Portuguese Law 63/2019, the trader is bound to consumer arbitration when the consumer requests it, in disputes worth up to 5.000 €. Consumers resident in Portugal may also use the electronic complaints book at www.livroreclamacoes.pt. None of this prevents recourse to the courts having jurisdiction under the applicable consumer rules.
